Welcome! By accessing or using our website at www.realtinyplants.com, you agree to comply with and be bound by the following terms and conditions (the "Terms"). Please read them carefully. If you do not agree to these Terms, you may not use this website or our services.
1. General Use
By accessing our website, you agree to use it for lawful purposes only. Any use of this site or its content for illegal activities, harmful conduct, or misleading practices is strictly prohibited.
2. Eligibility
You must be at least 18 years of age or have the consent of a parent or legal guardian to make a purchase on this website.
3. Product Descriptions and Handmade Variations
Our products are handmade and may have slight variations that make each piece unique. Differences in color, texture, and size are normal. Small air bubbles, slight asymmetry, minor tool marks, or bake lines may occur as part of the handmade process and add to the character of each item. Cactus size may also vary from the photo listing; however, each cactus is selected to ensure it fits properly in our tiny pots.
These natural characteristics do not affect the quality or functionality of the product and are not considered defects. By completing a purchase, you acknowledge and accept these variations.
4. Product Safety
Our tiny plant kits contain small parts and are designed for display and gentle care, not play. Some components are small, delicate, or pointy.
Our kits are not recommended for children under 3 due to choking hazards. For children ages 7 and older, adult supervision is recommended. These warnings are also printed on the product packaging.
Our tiny plant kits are intended for humans. Some plants and materials may be harmful to pets if chewed or ingested. We recommend keeping tiny plants out of reach of pets.
By completing a purchase, you acknowledge these safety considerations and accept responsibility for the safe use and placement of our products.
5. Product Availability and Orders
All products are subject to availability and acceptance by Real Tiny Plants LLC. We reserve the right to modify, discontinue, refuse, or cancel any product or order at our sole discretion.
Order confirmation emails acknowledge receipt only and do not constitute acceptance of the order. We may refuse or cancel any order due to product unavailability, suspected fraud or unauthorized transactions, pricing errors, policy violations, abusive or threatening communication, or other circumstances that pose a risk to our business.
If an order is canceled after payment has been processed, a full refund will be issued to the original form of payment.
6. Payment
All payments must be made in full at the time of purchase. We accept major credit cards and other payment methods as indicated on our website. All prices are listed in USD and include applicable taxes unless stated otherwise.
7. Shipping and Delivery
We aim to ship all orders within the time frames stated on our website. All orders are shipped via USPS. Shipping times are estimated and not guaranteed. Real Tiny Plants LLC is not responsible for delays caused by carriers or events outside our control.
Because our products contain live plants, packages should be brought indoors immediately upon delivery. We are not responsible for plants left outside, in mailboxes, or otherwise exposed to the elements after delivery. A tracking number is provided when your order ships; it is your responsibility to monitor your delivery status.
8. Returns, Refunds, and Replacements
We do not accept returns or issue refunds. All sales are final.
If your order arrives damaged, is missing components, or was not received, requests must be submitted within 72 hours of the confirmed delivery date and must include a photo where applicable. Requests submitted after this window may not be eligible for assistance.
We offer a 30-day plant guarantee on original adoption kit purchases, subject to eligibility requirements.

9. Changes and Cancellations
Changes or cancellation requests must be submitted within 24 hours of placing the order. After 24 hours, we will try our best to accommodate the request; however, it is not guaranteed. Once an order has shipped, no changes or cancellations can be made. If you need to intercept a package after shipment, you must contact USPS directly to request an interception.
10. Intellectual Property
All content on this website, including but not limited to text, images, graphics, logos, and designs, is the property of Real Tiny Plants LLC and is protected by intellectual property laws. You may not reproduce, distribute, or use any content without prior written permission from us.
11. User-Submitted Content (Photo Uploads and Permissions)
By uploading a photo through our Tiny Plant Registration Form, you grant Real Tiny Plants LLC a non-exclusive, royalty-free, worldwide, perpetual license to use, modify, reproduce, and distribute the image for marketing, promotional, and commercial purposes. This includes but is not limited to use on our website, social media, email campaigns, and advertisements.
You confirm that you own or have permission to share the uploaded photo. No compensation, attribution, or prior approval is required for the use of submitted photos. If you do not want us to use your photo, please contact us within 7 days of submission to opt out.
Real Tiny Plants LLC reserves the right to edit, crop, or remove any submitted images at our discretion. Submitted photos must not contain offensive, inappropriate, or copyrighted content owned by third parties.
12. Dispute Resolution
If you have a concern or dispute regarding your order or our services, please contact us first so we can attempt to resolve the issue directly. We ask that you reach out within a reasonable time frame so we can investigate and respond appropriately.
If we are unable to resolve the matter informally, any legal action must be brought in the courts located in San Diego County, California. Nothing in this section prevents either party from seeking relief in small claims court for eligible disputes.
13. Limitation of Liability
Real Tiny Plants LLC is not liable for any indirect, incidental, or consequential damages resulting from the use or inability to use our products or website. Our liability is limited to the total purchase price of the product in question.

15. Changes to Terms
